I-9 Update: 3 Things You Need to Know
1. By July 31, remotely verified I-9 ID’s must be reverified and viewed in person.
Context:
Between May 1, 2020 and April 30, 2022 the government allowed organizations to view I-9 ID’s digitally
This was a temporary solution during COVID
What to Do:
The government is now requiring organizations update those I-9’s where IDs were not viewed in person no later than July 31, 2022
Request any employees hired during that time present IDs in person for you or an authorized representative to view.
If employee is inactive, no action is needed.
We recommend attaching a simple form to the back of the I-9 stating ID’s were now viewed in person. Sign and date it
2. How to fix errors on ALL I-9 forms:
Context:
I-9 forms can be complex and tedious, but fines for mistakes can be expensive ($2K+ per error)
What to Do:
Update I-9’s done remotely during COVID and audit the rest of active employees’ I-9’s.
If you find an error, just draw a line through the mistake, correct it, and attach a correction memo to the I-9 indicating the error was found during the audit and has been corrected. Sign and date.
3. A new I-9 form is being created.
Context:
Current form expires October 31, 2022
Does not mean everyone needs to redo the I-9, but going forward, use the new form
What to Do:
Put a reminder on your calendar to check at the beginning of October for any news about the updated form.
