NYC Lactation Room Policy Update

Starting May 8, 2025, New York City employers with four or more employees will need to post their lactation room accommodation policy in a conspicuous place accessible to all employees. If applicable, the policy must also be posted on the employer's intranet.


These new posting requirements are in addition to the existing requirement that employers provide the policy upon hire. The policy must also be updated to include the state’s requirement to provide 30-minute paid lactation breaks and allow employees to use existing paid break or meal time for any additional time beyond the 30 minutes.


The NYC Commission on Human Rights is expected to update its Model Lactation Accommodation Policies to reflect these changes by the law's effective date. You can view the current model policies here.
